Under the MPs’ Scheme of Business Costs and Expenses (‘the Scheme’), Staffing Expenditure may be claimed to meet the cost incurred in the provision of staff to assist with the performance of an MP’s parliamentary functions. It may only be claimed for the salary of one employee who is a connected party (unless an MP employed more than one connected party prior to 7 May 2010).
Following the end of each financial year, we publish information on each MP’s annual expenditure, which includes information on the employment of any connected parties. Specific information relating to the working arrangements of staff members is ‘personal data’, as defined by the Data Protection Act. When considering whether or not it is appropriate to disclose personal data under the Freedom of Information Act, we must consider whether or not it would be ‘fair’ and ‘lawful’. It is unlikely to be in the reasonable expectations of staff members, especially those in comparatively junior roles, that personal information relating to their employment (such as their personal job descriptions) will be put into the public domain.
We believe there is a higher expectation of disclosure when the information relates to MPs and their connected parties, as there is a higher public interest in such information. However, as this information relates to a junior staff member who is not a connected party, we do not believe there is a reasonable expectation of disclosure and as such, this information is being withheld from disclosure under section 40 of the FOIA. Section 40(2) provides that personal information about third parties is exempt information if disclosure would breach the fair processing principle (Principle 1) of the DPA, where it would be unfair to those persons or is confidential.
